Please carefully read these Terms and Conditions of the offer for the reward „Photonics Innovation Awards“ before participating in the competition for the reward. They form the legal bases for the competition for the reward.

1. Eligibility/Personal Requirements for Participation:

1. The competition is open to traders pursuant to sec. 14 German Civil Code, i.e. a natural or legal person or a partnership with legal personality who or which, when concluding a legal transaction, acts in exercise of their trade, business or profession. Consumers pursuant to sec. 13 German Civil Code do not qualify and are excluded.
2. Traders which, by operation of applicable local laws are prohibited and/ or restricted from participation in rewards, do not qualify and are excluded.
3. Participants must possess the legal capacity to enter into agreements under the laws of their respective countries.
4. Employees, contractors, and immediate family members of Hamamatsu Photonics Europe GmbH and affiliated companies are not eligible to participate.

2. Rewards/„Prices“:

The winner of the „Photonics Innovation Awards“ will be offered a contractual agreement with the following reward:

1. The winner receives a payment of EUR 10,000.00.
2. The winner grants Hamamatsu Photonics Europe GmbH the intellectual property rights stated in No. 5, below, and, thereby, enables Hamamatsu Photonics Europe GmbH to adequately promote the award-winning participation.

3. Submission Requirements/Conditions:

Any application („Submission“) for the Rewards/ Prices must fulfil the following requirements:

1. Participants must submit a concept that includes the use of Hamamatsu Photonics’ Technology within their proposal.
2. Each participant can submit only one Submission.
3. Submissions must be original and must not infringe upon any third-party rights.
4. Proposals can be submitted until 08.05.2025

 

Submissions which do not meet the requirements do not qualify and are excluded. Hamamatsu Photonics Europe GmbH reserves the right to refuse/ deny participation.

4. Panel and Judging Criteria:

Entries will be evaluated based on the following criteria:

1. Award-Judging Panel
   

   Hamamatsu Photonics Europe GmbH shall, in its free discretion, appoint a panel (“Panel”) of at least three persons to deliver a judgement and determine the winner of the Award. The Panel shall, then, evaluate the submissions and select a winner based on the criteria stated below.

2. Submissions will be evaluated based on the following criteria:
   1. Innovation: The degree to which the project introduces novel solutions or advancements that distinguish it from existing technologies.
   2. Relevance and Impact: The significance of the project's contribution to societal needs and challenges.

   3. Feasibility: The practicality and ease of implementation of the project. Consider factors such as technical challenges, resource requirements, and the likelihood of successful execution within a reasonable timeframe.

   4. Material Quality: The durability, reliability, and overall excellence of the materials and components proposed.

   5. Market Potential: The viability of the project in terms of market demand and commercial success.

5. Intellectual Property:

1. To receive the reward, each winner shall grant Hamamatsu Photonics a non-exclusive, royalty-free, perpetual license to use, reproduce, publish, and display the basic idea and company name for promotional and other purposes. The respective license shall not affect the participant's ownership of the intellectual property rights. Details will have to be agreed in a separate agreement.
2. The winners retain ownership of the intellectual property rights associated with their idea and may use or license it to others independently of this agreement.

6. Judging and Winner Selection:

1. Submissions will be judged based on the criteria listed above. The evaluation of these criteria lies solely in the Panel’s free discretion.
2. The decision of the judging panel is final and binding.

7. Notification of Winners:

Winners will be notified via email or other adequate contact information provided at the time of Submission.

8. Modification or Termination:

1. Hamamatsu Photonics Europe GmbH reserves the right to modify, suspend, or revoke this Offer for Reward at any time before the Panel has issued a decision for any reason.
2. Hamamatsu Photonics Europe GmbH reserves the right to update or revise these terms and conditions as necessary, with any changes being effective immediately upon posting on the competition website.

9. Governing Law:

This offer and its terms and conditions are governed by and construed in accordance with the laws of Germany; the CISG does not apply.

2. The following personal data is required for participation in the competition:

   - e-mail address

   - Telephone number

3. The controller collects, processes, uses and stores the personal data required to carry out the competition only for the duration/ term of the competition. Personal data will not be used for other purposes by the organizer or third parties without the express consent of the participant. The data mentioned under 2. will only be processed for the following purposes:
   1. to identify you as a contractual partner if and when you win a price/ reward
   2. to pay out the reward to you, if applicable. The stored information will not be used for any other purpose.
4. All personal data of the participants will be processed and used by the organizer in accordance with the statutory provisions.  The legal basis for the processing of your personal data in the context of the competition is in accordance with Art. 6 para. 1 lit b GDPR for the fulfillment of the negotiation for a reward-competition contract.
5. The personal data will be deleted 14 days after it has been determined whether there has been a successful prize win or a successful conclusion of a contract to receive the prize.

7. If your personal data is processed on the basis of legitimate interests in accordance with Art. 6 para. 1 sentence 1 lit. f GDPR, you have the right, in accordance with Art. 21 GDPR to object to the processing of your personal data, provided that there are grounds relating to your particular situation or if the objection is objection is directed against direct advertising.  In the latter case, you have a general right to object, which will be implemented by us without specifying a particular situation.

11. Withdrawal of Participation and Contact for Questions
